This agreement describes the terms and conditions applicable to your use of our services at TeamSpeakHost.com. By accessing, viewing, using or downloading materials from this web site, you agree to be bound by these terms.

In this agreement, “we” mean TeamSpeakHost.com “you/users” means the members and/or clients, as the context requires. This site means TeamSpeakHost.com Internet web site.

We may revise this agreement at any time by posting revised terms on this web site. Such revised terms take an immediate effect unless specified. Please note that it is your responsibility to check this agreement periodically.

Applicable Law

This site is owned and operated by TeamSpeakHost.com, a division of Layer Cube Technologies Inc. in Canada.

TeamSpeakHost.com may make changes and/ or improvements in the products described in this site at any time without notice. Use of TeamSpeak

By virtue of using our service, you agree to use TeamSpeak as is provided. You may not, under any circumstances, resell your TeamSpeak or add unauthorized slots or servers, to your server. Further, by accepting TeamSpeak through TeamSpeakHost.com, thus agreeing to this TOS, you agree that we will not be held liable for any takeover of your server by any outside, unauthorized, 3rd party. Contravention of any part of this TOS may result in an immediate termination of service without redress to a refund.

99.9% Uptime Guarantee

TeamSpeakHost.com offers a 99.9% Uptime Guarantee. That means your TeamSpeak server is guaranteed to be operational 99.9% of the time each individual month. This guarantee allows for 40 minutes of TeamSpeak server outage per month as defined in this document. For any downtime past the agreed upon 40 minutes, we will, at the customers request, refund their most recent months payment. Regardless of the number of outages, all refunds are limited to one month's TeamSpeak fees.

Note – For the purposes of this guarantee, downtime will only be considered for service outages that last for 5 minutes or longer.

TeamSpeakHost.com will not be held responsible for outages resulting from non-TeamSpeakHost.com processes including, but not limited to, Internet NAP failures or congestion and backbone failures. Additionally, TeamSpeakHost.com will not be held responsible for outages resulting from malfunctioning customer scripts or applications that are installed by the customer, or for unusual traffic spikes or "denial of service" attacks.

Bandwidth

As a Scalable Voice Communications provider, TeamSpeakHost's bottom line is determined partially by the amount of bandwidth customers utilize. We can normally balance that cost and utilization while continuing to provide great service to all customers. Customers will not be charged for the bandwidth consumed, nor do we have specific limits or caps on that bandwidth. However, if you utilize any of your TeamSpeakHost services in a manner which consumes excessive bandwidth or affects our core equipment, overall network performance, or other users' services, TeamSpeakHost may require that you cease or alter these activities. Under no circumstances is there to be any type of continuous broadcasting such as radio stations, music, etc. TeamSpeakHost reserves the right to cancel servers and accounts without notice or compensation if the terms outlined above are not adhered to.

Penalties

Without limiting any other remedies available to us we may at any time on notice to you with immediate effect terminate our obligations to you under this agreement and prohibit your future use of this web site if you have engaged in any unlawful or improper activities in relation to your use of our services at this web site or if you breach any of the terms of this agreement.

Limit of our Liability

We are not liable to you for any indirect or consequential loss or damage from your use of our services at this web site.

Severance

In the event that any term of this agreement is held to be invalid or unenforceable by judicial decree or decision, the remainder of this agreement shall remain valid and enforceable.

Privacy Policy

Privacy on the Internet

This privacy statement is applicable to all TeamSpeakHost.com web-sites.

TeamSpeakHost.com respects the privacy of its Internet users and will protect that privacy as vigorously as possible.

TeamSpeakHost.com does not collect information that personally identifies individuals except when individuals provide such specific information on a voluntary basis. There may be occasions where specific personal information is requested before an individual can enter certain sections of a TeamSpeakHost.com site. For example, information is needed to order a TeamSpeak server or to participate in any TeamSpeakHost online forum. This kind of registration helps us to ensure that content standards on these sections of the site are rigorously upheld or that contact can be made with clients as needed by us.

In all such cases, TeamSpeakHost.com will collect only information that is voluntarily provided by the user and undertakes that such information will be kept strictly confidential. Individual information provided to TeamSpeakHost.com to gain access to any of its sites will not be sold or made available to a third party.

TeamSpeakHost.com does reserve the right, however, to perform statistical analyses of user behaviour and characteristics, in order to measure interest in and use of the various sections of its sites so as to improve design and navigation and to gather marketing information for our own use. Only aggregated data from these analyses, not individual data, will be used for this purpose.

As well, users should be aware that certain non-personal information and data may be automatically collected by TeamSpeakHost.com through the operation of what are called "cookies". "Cookies" are small text files that identify an individual computer's browser entering a web site. They allow the site to track that browser's movement through the site over several sessions. Through cookies, a web site can recognize repeat users, facilitate the user's access to and use of the site and allow a site to track usage behaviour that will allow content improvements. TeamSpeakHost.com uses cookies only for the above-mentioned purposes and will not use them to identify users or to track non-TeamSpeakHost.com usage.

If you do not want a cookie placed on your computer by TeamSpeakHost.com, you may disable cookies altogether by modifying the Preferences section of your Firefox or Internet Explorer browser (under Edit/Preferences/Advanced). Note that it is possible that some aspects of TeamSpeakHost.com sites may be unavailable to you if you choose this option.

If you have no problem accepting cookies, but wish to be informed of their appearance, you may turn on a warning prompt by modifying the cookie warning section in Edit/Preferences/Advanced.

Privacy Standards

TeamSpeakHost.com's privacy provisions are based on the CSA International's Model Code for the Protection of Personal Information, recognized as a national standard in 1996. The standard addresses the ways in which organizations collect, use and disclose personal information. It also addresses the rights of individuals to have access to their personal information and to have it corrected if necessary.

Personal information shall not be used or disclosed for purposes other than those for which it was collected, except with the consent of the individual or as required by law. Personal information shall be retained only as long as necessary for the fulfilment of these purposes.

Accuracy

Personal information shall be as accurate, complete, and up-to-date as is necessary for the purposes for which it is to be used.

Safeguards

Personal information shall be protected by security safeguards appropriate to the sensitivity of the information.

Openness

An organization shall make readily available to individuals specific information about its policies and practices relating to the management of personal information.

Individual Access

Upon request, an individual shall be informed of the existence, use and disclosure of his or her personal information and shall be given access to that information. An individual shall be able to challenge the accuracy and completeness of the information and have it amended as appropriate.

Challenging Compliance

An individual shall be able to address a challenge concerning compliance with the above principles to the designated individual or individuals accountable for the organization's compliance.

Refund Policy

Servers that do not meet your expectations must be cancelled within thirty (30) days of purchase.

If you are not satisfied with the operation of your TeamSpeak, or any aspect of our product or service, you can request, and will receive, a full refund (less $0.15 per slot license fee) within the first 30 days.

This does not preclude our right to offer refunds outside of this time period if the situation warrants. We treat all our clients EXACTLY the same way we would expect to be treated.

Delivery Policy

Your TeamSpeak server is built, activated and provided to you within minutes of your order completion. The process is fully automated, so the service is robust and very efficient.

If for any reason, you do not receive the required information, or you receive it and it isn’t set up properly, you may submit a request for us to fix it via our 24/7 support system. The support system can be found within the Client Control Panel. You may also email support@teamspeakhost.com.
